1. Services

I, Raphael Ramos, provide digital marketing services, including but not limited to the development of email strategies, creation of email content and sequences, and the evaluation and optimization of email campaign performance. Each project or engagement is tailored to the specific needs and objectives of the client, as outlined in the initial proposal or signed agreement.

2. Eligibility

To use my services, you must be at least 18 years old or the age of majority in your local jurisdiction and must have the legal authority to enter into binding agreements either on your own or on behalf of a company or organization.

3. Payments and Fees

All fees are determined in advance and agreed upon in writing before any work begins. Depending on the service scope, an upfront payment may be required. Invoices must be paid by the due date specified. Late payments may result in a delay or suspension of services. Unless otherwise stated, all pricing is in U.S. Dollars (USD) or the agreed currency.

4. Revisions and Feedback

Each service package includes a predetermined number of revisions, as specified in the proposal. Additional revisions beyond the agreed limit may incur additional charges. To maintain project timelines, I ask that clients provide clear and timely feedback.

5. Client Responsibilities

Clients are responsible for providing all necessary information, creative assets, and platform access needed to complete the agreed services. You confirm that any content or materials you provide do not infringe upon third-party rights. Timely collaboration and communication are essential for smooth project execution.

6. Intellectual Property

Once full payment has been received, the rights to all original email copy, strategy documentation, or content created for the project are transferred to the client. I retain the right to display non-confidential and non-exclusive samples of completed work in my portfolio unless otherwise agreed upon in writing.

7. Confidentiality

I respect your privacy and the confidentiality of your proprietary information. Any client materials, account access, or sensitive data shared with me will remain confidential and will not be disclosed to third parties without consent.

8. Cancellation and Termination

Either party may terminate the agreement by providing written notice. If a project is terminated after work has begun, the client is responsible for compensating me for all work completed up to the termination date. Refunds will not be issued for work that has already been completed and delivered.

9. Disclaimers

I do not guarantee specific results from the use of my services. All strategies and recommendations are implemented at the client’s discretion.

10. Limitation of Liability

To the maximum extent permitted by law, I shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of my services.

11. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, and any legal disputes shall be resolved in its courts.

12. Changes to These Terms

I reserve the right to update these Terms at any time. Any changes will be posted on my website, and your continued use of my services following those changes constitutes your acceptance of the revised Terms.
